Terms of Service

Plain-English summary: PocketCache provides software that nonprofits use to run their own round-up giving programs. When you use a nonprofit's PocketCache-powered app, that nonprofit is the one collecting donations — not PocketCache. All charges happen on the nonprofit's own Stripe account. PocketCache never touches donation money. PocketCache's only revenue is a flat, mandatory $1.00/month service fee collected from donors — charged only for months you actively round up; it rolls over with sub-minimum balances and collects in the same single charge. The fee is not tax-deductible and is never collected from nonprofits. Separately, donors see a pre-checked option to cover the nonprofit's card-processing costs (~2.2% + 30¢); this amount passes through to the nonprofit as part of the donation and is tax-deductible. PocketCache receives none of the processing-cover amount. With the toggle on, the nonprofit nets 100% of round-ups; with it off, the nonprofit nets round-ups minus standard card processing — the same as any card donation. Nonprofits never pay PocketCache anything, under any circumstances. PocketCache is not available to California residents at launch.

1. About PocketCache

PocketCache, LLC ("PocketCache," "we," "us," or "our") is a software company that provides white-label round-up giving technology to nonprofit organizations ("Nonprofits"). PocketCache provides technology services only. PocketCache is not a fundraiser, fundraising counsel, charitable organization, bank, financial advisor, or payment processor. PocketCache does not solicit contributions on behalf of any organization, does not provide fundraising advice or consulting, and never receives, holds, controls, or transmits donation funds.

2. How PocketCache Works

Nonprofits license PocketCache's software platform to power their own branded round-up giving programs. When you use a Nonprofit's PocketCache-powered app, the Nonprofit is the soliciting party and merchant of record for all donations. All donor charges are processed on the Nonprofit's own Stripe account. The Nonprofit issues all tax receipts and donor communications. PocketCache's role is limited to providing the technology that facilitates these transactions.

3. Eligibility

You must be at least 18 years old and a resident of the United States to use PocketCache. By using the service, you represent that you meet these requirements.

California: PocketCache's donor services are not currently available to California residents. If you are a California resident, you may not create a donor account. We are working to expand availability and will update this notice when California becomes supported.

4. Account Registration

You sign up using Apple, Google, or Facebook single sign-on. PocketCache does not create or store passwords; your sign-in provider secures your account, including any two-factor protection you have enabled with them. You may have only one account per person. By creating an account, you represent that all information you provide is accurate and that you will keep it current.

4a. Communications

Service messages — charge notices, receipts, payment failure alerts, security notifications, and other transactional messages — are always sent to your registered email address and via in-app notification. You cannot opt out of service messages while your account is active; they are necessary to operate the service.

Marketing communications and data sharing with your Nonprofit: At signup, you will see a pre-checked election authorizing: (a) PocketCache to send you product updates, impact stories, and giving opportunities; and (b) PocketCache to share your contact information and giving activity with your Nonprofit, solely for their donor newsletter, campaigns, and communications. This election is separate from service messages and is entirely voluntary. You may change this preference at any time in Settings › Notifications, or by clicking the unsubscribe link in any marketing email. Withdrawing consent stops future marketing communications and future data sharing with your Nonprofit; it does not affect service messages or data already shared.

Push notifications are governed by your device’s operating-system permission settings. You may enable or disable push notifications at any time in your device settings. Transactional push notifications (charge confirmations, payment failures) are sent only when you have granted notification permission; PocketCache does not override device-level settings.

Your Nonprofit’s use of any contact information or giving data shared under your election is governed by the Nonprofit’s own privacy policy, not these Terms.

5. Your Relationship with the Nonprofit

When you use PocketCache through a Nonprofit's app, your donations and account activity are governed by the Nonprofit's own terms and privacy policy, in addition to these Terms. PocketCache is not a party to your donation transaction. The Nonprofit is responsible for honoring charitable commitments and issuing tax receipts, including any year-end giving summaries or tax acknowledgment paperwork, which are sent to the email address associated with your sign-in. You should direct any questions about your donations to the Nonprofit directly.

6. Linking Your Card (Plaid)

To calculate your round-ups, PocketCache uses Plaid Technologies, Inc. to connect to the card you choose to track. By linking your card, you authorize PocketCache and Plaid to access your transaction history and account metadata on that card on an ongoing basis, solely to calculate round-up amounts.

Plaid's services are subject to Plaid's own terms and privacy policy. You can revoke access at any time by visiting my.plaid.com or removing the linked card in the app. Revoking access will stop future round-up calculations. We do not use your transaction data for any purpose other than calculating round-ups and do not sell it.

7. Round-Up Donations

PocketCache monitors your linked card's transactions via Plaid and rounds each transaction up to the nearest dollar. The difference — your "round-up" — accumulates throughout the month. Once a month, the Nonprofit charges your payment method for your accumulated round-ups. The charge appears under the Nonprofit's name on your bank or card statement. The Nonprofit issues your tax receipt directly.

Accumulated round-ups below the Nonprofit's monthly minimum (default $5, configurable per nonprofit) are not charged that month; they roll over to the following month, and any applicable service fee rolls over with them. Regardless of the rollover minimum, a settle-up charge runs at least once every 3 calendar months, collecting all accrued round-ups and fees. If you cancel your account, you choose whether to send your accrued round-ups as a final donation or waive them (see Section 12).

8. Service Fee

PocketCache charges a flat, mandatory $1.00/month service fee for each calendar month in which your linked card generates round-ups. The fee is non-optional and is PocketCache's only revenue. In months where your balance rolls over below the minimum, the fee accrues and is collected together with your round-ups in the eventual single charge. This $1.00 fee is not tax-deductible and is never collected from the Nonprofit.

Separately, at checkout you will see a pre-checked option to cover the Nonprofit's card-processing costs (approximately 2.2% + $0.30 per monthly charge). This processing-cover amount: (a) is a voluntary donation to the Nonprofit, not a fee to PocketCache; (b) is tax-deductible as allowed by law; (c) passes through entirely to the Nonprofit — PocketCache receives none of it; and (d) causes the Nonprofit to net 100% of your round-ups for that billing cycle. If you uncheck this option, the Nonprofit receives your round-ups minus standard card-processing costs — the same outcome as any card donation to a nonprofit. The Nonprofit issues all tax receipts.

9. ACH Payment Authorization

ACH Debit Authorization: By selecting bank account (ACH) as your payment method, you authorize the Nonprofit and its payment processor (Stripe) to initiate recurring monthly electronic debit entries to your designated bank account for: (1) your accumulated round-up total; (2) the $1.00/month service fee (mandatory); and (3) if you elected to cover the Nonprofit's card-processing costs, that processing-cover amount (approximately 2.2% + $0.30 of your round-up total), which is paid to the Nonprofit as part of your donation. This authorization will remain in effect until you cancel your account or change your payment method in the app. To revoke, update your payment method in Settings or contact support@pocketcache.app.

10. PocketCache's Fees to Nonprofits

PocketCache charges Nonprofits nothing — ever. The $1.00/month service fee is collected from donors; no portion of it is invoiced to or collected from the Nonprofit. PocketCache does not invoice, bill, or assess any charge against Nonprofits under any circumstances. PocketCache's revenue comes solely from the flat monthly fees paid by donors. Nonprofits will never receive an invoice from PocketCache.

11. Failed Payments

If your monthly payment is declined or returned, the Nonprofit (via Stripe) will typically retry the charge once after approximately 3 days. If the retry fails, your account may be paused and you will be notified to update your payment method. Round-ups continue to accumulate during a payment pause. Service fees continue to accrue as well, and the regular 3-month settle-up schedule applies regardless of the pause.

12. Cancellation

You can cancel your PocketCache account at any time from the Settings screen. There is never a fee or penalty for cancelling. At cancellation, you may choose to send your accrued round-ups as a final donation — which triggers a final settle-up charge covering all accrued round-ups, the processing-cover amount (if elected), and the service fee accrued through the cancellation date — or decline, in which case your uncharged round-ups and any unpaid service fees are simply waived. Declining the final donation creates no further obligation of any kind. After any final settle-up charge is processed, no further charges will be made to your payment method.

12a. Refunds

Because every donation charge is processed on your Nonprofit's own Stripe account, refunds of donations are decided by the Nonprofit at its sole discretion. PocketCache will promptly communicate any refund or cancellation request you submit to the Nonprofit, and may process an approved refund on the Nonprofit's behalf at the Nonprofit's direction. PocketCache may refund its own $1/month service fee at its sole discretion — including in alignment with, or at the request of, its Nonprofit partners.

13. Data and Privacy

We use Plaid to access your linked card's transaction data for round-up calculation only. We use Stripe to process payments. We do not sell your financial data. Please see our Privacy Policy for full details.

14. Prohibited Conduct

You may not use PocketCache to launder money, violate any law, misrepresent your identity, interfere with the platform's operation, or attempt to access data you are not authorized to access.

15. California

PocketCache's donor services are not currently available in California. California residents are not eligible to create donor accounts. This restriction applies at launch and will be updated when California becomes supported.

16. Disclaimers and Limitation of Liability

PocketCache is provided "as is" without warranty of any kind. We do not guarantee that the service will be uninterrupted or error-free. PocketCache is not liable for acts or omissions of Plaid, Stripe, any Nonprofit, or any financial institution.

To the maximum extent permitted by law, PocketCache's total liability to you for any claim arising from these Terms or use of the service is limited to the amount you paid us in processing fees in the 3 months preceding the claim.

17. Arbitration

Any dispute arising from these Terms or use of PocketCache that cannot be resolved informally will be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration will be conducted in Wisconsin. You and PocketCache both waive the right to a jury trial and the right to participate in any class action. You may opt out of arbitration within 30 days of first use by emailing legal@pocketcache.app.

18. Governing Law

These Terms are governed by the laws of the State of Wisconsin, without regard to its conflict-of-law provisions.

19. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via email or in-app notification at least 30 days before the change takes effect. Continued use of PocketCache after changes constitutes acceptance of the updated Terms.
